It is critical that drivers of vehicles which fall under the scope of an Operators Licence are fully compliant with the laws pertaining to Drivers Hours, break, rest, and how to use a Tachograph.
Not only will the driver receive either a fixed penalty fine or a summons to court, but the Operator has an obligation to notify the Traffic Commissioners Office of the offence within 28 days. This could lead to questions being asked with regard to broader compliance of the Operator.
The Traffic Commissioner expects that Operators have suitable systems in place to not only find infringements on their drivers records but also be able to demonstrate a system to ensure the same infringement does not happen in the future.
